The Senate approved Emil Bove as a federal judge in the United States Court of Appeals for the Third Circuit. The vote will place Bove — who has been accused of intentionally misleading federal courts on behalf of the Trump administration and lying to Congress — in a lifetime appointment to one of the most powerful positions within the judiciary.

In a 50-49 vote, GOP Sens. Susan Collins of Maine and Lisa Murkowski of Alaska broke from the rest of their party to join all Democrats in opposing.

President Donald Trump nominated Bove for the position after Bove served on Trump’s criminal defense team prior to taking office for a second time.

The vote took place amid a growing scandal surrounding Bove, who this month was accused by three separate whistleblowers of engaging in deception towards the judiciary and lawmakers in order to carry out Trump’s agenda. Two of the whistleblowers allege that Bove, in his role as Principal Associate Deputy Attorney General, instructed lawyers at the DOJ to ignore court orders that would interfere with the Trump administration’s plans to deport undocumented migrants under the Alien Enemies Act.

The third whistleblower, whose existence was reported by The Washington Post on Tuesday, alleged that Bove lied to senators about his role in the dismissal of federal corruption charges against NewYork City Mayor Eric Adams during his confirmation hearing.

In a letter sent Tuesday, Sens. Adam Schiff (D-Calif.) and Cory Booker (D-N.J.) asked William Blier, the Justice Department’s acting inspector general, if his office is in the process or plans to investigate Bove. Schiff and Booker insisted that it was “imperative” that the Senate have “full knowledge” before conducting a final vote on Bove, per the letter reviewed by Politico.  “In the event these whistleblower complaints and other reports have not already prompted investigations by your office, we urge you to undertake a thorough review of these disclosures and allegations,” they wrote.
